TERMS & CONDITIONS

Please read our general booking, cancellation, payment and other conditions carefully:

  1. Definitions
    ​Dive-Thailand includes “the Company” and all of its affiliates, officers, agents, employees, workers, directors and agents.
  2. General booking
    ​2.1 All customers must provide proof of diving certification (minimum Open Water certification).
    2.2 All customers must complete and sign a Liability Release and Assumption of Risk form.
    2.3 The Company is not permitted to offer medical advice.
    2.5 The maximum allowable depth on vessels is 30 metres, 100 feet for Open Water Divers using the Deep Adventure
    Diving Certification, Advanced Divers, Divemaster and Instructors. Open Water Divers without additional deep diving training may not dive deeper than 18 meters (60 feet).
    2.6 The Company reserves the right to change and/or cancel diving arrangements for the reasons listed below, but is not limited to these:
    2.6.1 The remoteness or inaccessibility of a diving destination.
    2.6.2 local mores, war, political unrest and other hostilities (whether or not war is declared).
    2.6.3 Acts of God (including flood, earthquake, storm, hurricane or other natural disaster); And
    2.6.4 Any other resulting technical or mechanical difficulties. No refunds will be given for changes or cancellations resulting from such events.
    2.7 Customers or students who for any reason do not participate in any dives of a trip or course training or training dives will not receive a refund from the Company for any unused or uncompleted portion of the trip or course.
  3. Insurance
    ​3.1 Customers are required to take out appropriate travel insurance with a reputable insurance provider that is appropriate for the activities they are undertaking. Such insurance should at least comprehensively cover:
    Diving, Medical, Travel, Evacuation, Personal Liability and Trip Cancellation Provisions. This insurance cover is mandatory for all customers on board all boats and customer premises. The company shall not be liable for any financial or personal loss or injury resulting from the failure of customers to obtain such insurance. On departure days we require written PROOF in English from the customer’s insurance provider that it covers evacuation and recompression chamber treatments.
    3.2 The Company accepts no liability for loss of or damage to luggage or diving equipment on board the boat, nor during transfer to or from the boat or at any of Dive Thailand’s premises.
  4. Price and Payment
    ​The number of dives in a package is an estimate based on usual diving circumstances and is not a guarantee. Circumstances may arise that require a change in the number of dives, such as but not limited to: adverse Weather conditions, personal illness, technical or mechanical difficulties, remoteness/inaccessibility of dive site or personal choice. Circumstances such as these may result in a reduction in this estimated number of dives. No refund will be given in such circumstances.
  5. Customer Obligations
    ​5.1 If the Customer is negligent or irresponsible and causes damage or loss to Company property and equipment, the Customer shall reimburse the Company in full for any loss or damage up to the then current selling price.
    5.2 The customer undertakes to be physically, emotionally and mentally able to participate in the activities they have registered. Any resulting injury or inconvenience due to lack of fitness will not be considered grounds for a claim or refund.
    5.3 Day and Overnight Excursions in Thailand: The customer may prohibit participation in one or more dives if they are physically, mentally or emotionally unable to dive, a clear lack of respect for the rules and regulations of the National Marine Park abuses or harms them You live in the sea, consume alcohol between dives, or do not follow general international standards and practices for safe diving.
  6. Force Majeure
    ​6.1 The company reserves the right to change, postpone and/or cancel diving arrangements if the remoteness or inaccessibility of the diving destination, local customs, acts of God (fire, flood, earthquake, storm, hurricane or other natural disaster) or war , political unrest and other hostilities, whether or not war is declared, or other technical or mechanical difficulties will cause the Arrangements to become unsafe, dangerous and/or impracticable.
  1. Cancellation
    ​7.1 The Company will refund all amounts paid by the Client to the Company if the Company itself cancels a trip or course for reasons other than those set out above. The Company accepts no financial responsibility for any itinerary changes or cancellations due to circumstances beyond the Company’s control such as: B. but not limited to those mentioned above.
    7.2 If a client requires an emergency evacuation and the boat has to return to shore, the company accepts no financial responsibility for any resulting itinerary changes.
    7.3 If a cancellation is made more than 7 days before the start of the trip, all amounts paid will be refunded.
    7.4 If canceled between 7 and 1 day before the start of the trip, the deposit will not be refunded.
    7.5 If a cancellation has been made by a customer whose booking has been received and processed by one of the Company’s representatives, the customer must contact that representative for any type of refund. The company is not able to process a cancellation by the customer or prepare a refund for him.
    7.6 All PADI Professional courses are non-refundable.
  2. Severability
    The failure of a party to enforce any provision of this Agreement because such provision(s) is unlawful, void or unenforceable shall not affect the validity or enforceability of any other provision of this Agreement.
  3. Task
    ​Customer shall not assign any of its responsibilities or duties or delegate any of its duties under this Agreement without the express written consent of Company.
  4. Waiver
    The failure of a party to perform one or more of its obligations under this Agreement shall not constitute a waiver of any contractual performance of any other obligation under the Agreement.
  5. Entire Agreement
    ​This agreement contains all rights and obligations of both parties in relation to the subject matter of the contract. No other agreement, understanding or obligation is granted or implied by this Agreement.
  6. No Third Parties
    ​Nothing in this Agreement shall confer any rights, express or implied, on any third party.
  7. Governing Law
    ​This Agreement shall be governed by, and construed and enforced in accordance with, the laws of the Kingdom of Thailand. Should any question or matter arise under the Agreement or any of its provisions, it shall be decided exclusively in the courts of the Kingdom of Thailand, to the exclusion of any other court or tribunal.
